These Terms of Service (the “Terms”) govern your access to and use of MoverScan — the MoverScan web application, website, data, and any related services and paid features (together, the “Service”), operated by MoverScan (Portland, Oregon) (“we,” “us”). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
The Service
MoverScan is a hosted web application that helps you reach new homeowners first. You pick a 5-digit US ZIP code and run a scan; the Service searches recent public property records and licensed data sources for that ZIP and returns recent home-sale leads — such as owner name, property address, sale price, sale date, and property type — in your account workspace. The Service runs on our servers and you access it with a web browser; there is nothing to install.
A home-sale record is a signal that a person may have recently moved; it is not a confirmation. We do not guarantee that any individual has moved, currently resides at any address, or wishes to be contacted. You are responsible for how you use the Service and for verifying any information before relying on it.
Eligibility & your account
You must be at least 18 years old and able to form a binding contract to use the Service. You may use the Service only for lawful business purposes and only in compliance with these Terms and all applicable laws, regulations, and third-party terms.
You are responsible for your account: provide accurate information, keep your sign-in credentials confidential, and do not share your account or resell access to it. All activity under your account is your responsibility. If you believe your account has been accessed without authorization, tell us promptly at johnykidhole234@gmail.com.
Free trial
Every new account includes 2 free ZIP scans. No payment method is required to sign up or to use them. Free scans are full scans, not samples, and they do not expire. The trial never converts into a paid subscription on its own — subscribing is a separate, explicit step you take from your billing page, and until you take it we have no way to charge you.
The trial allowance is intended as one trial per customer. We may limit, suspend, or withdraw free scans where we see multiple accounts created to farm trials or other abuse.
Subscription & auto-renewal
The Service offers one paid plan: MoverScan, at $17 (USD) per month, which includes 10 ZIP scans per monthly billing period. Current pricing and allowances are always shown on our pricing page and on your billing page in the app.
- Price
- $17 per month · 10 ZIP scans included each billing period
- Renewal
- Auto-renews monthly — your payment method is charged $17 at the start of each period until you cancel
- Cancel
- Anytime, self-serve, from your billing page — effective at the end of the period you have paid for
- Trial
- 2 free ZIP scans · no card required · never auto-converts
Auto-renewal. The subscription is month-to-month and renews automatically: your payment method is charged $17 at the start of each monthly billing period until you cancel. You may cancel at any time as described in Section 6 (Cancellation & refunds); cancellation takes effect at the end of the billing period you have already paid for.
Payment processing. Payments are processed by Stripe, our payment processor. Your card details are collected by Stripe and never stored on our servers. If a payment fails or is reversed, we may suspend paid features until it is resolved.
Changes. We may change prices or plan allowances with at least 30 days’ advance notice; changes take effect at your next renewal. If you do not agree to a change, cancel before the renewal in which it takes effect and you will not be charged the new price. You are responsible for any taxes associated with your purchase.
Scan credits & coverage
Plan allowances are measured in scans. These rules govern how scans are counted:
- One scan = one ZIP. A scan searches recent records for a single 5-digit US ZIP code. Paid accounts include 10 scans per monthly billing period; trial accounts include 2 free scans.
- Re-opening is free. Returning to a ZIP you have already scanned within the same billing period does not use another scan.
- Scans do not roll over. Unused scans expire at the end of the billing period, have no cash value, and are not redeemable.
- Coverage is checked first. You can enter any US ZIP, but our deepest records coverage today is the Portland, Oregon metro, with national coverage rolling out. We check coverage before a scan runs — a ZIP outside deep coverage is flagged up front and does not use a scan.
- Failures are not charged. If our data sources are unavailable and a scan cannot complete, that scan is not counted against your allowance.
- Quiet results still count. County records lag closings — often by 30–60 days — so a completed scan can honestly return few or no new records. A scan that completes uses a scan even when the county has recorded nothing new.
Cancellation & refunds
Cancel anytime, yourself. You can cancel your subscription from the billing page in the app: the “Manage / Cancel subscription” button opens our payment processor’s customer portal, where cancellation takes a couple of clicks. No phone call, email, or retention conversation is required. If anything gets in your way, email johnykidhole234@gmail.com and we will cancel it for you.
When it takes effect. Cancellation is effective at the end of the billing period you have already paid for. You keep access and any remaining scans until then, and you will not be charged again.
Refunds.
- Billing mistakes are refunded. If you are charged in error — for example after cancelling, or twice for the same period — email johnykidhole234@gmail.com and we will refund the erroneous charge.
- If we terminate your access without cause during a period you have paid for, we will refund the prorated unused portion of that period.
- Otherwise, fees already paid are non-refundable and we do not prorate partial months, except where applicable law requires otherwise.
- The trial is free and requires no card, so there is nothing to refund.
Nothing in this section limits any non-waivable statutory rights you may have under the law of your place of residence.
Acceptable use
You are solely responsible for how you contact the people who appear in your leads and for complying with every law that governs that contact. You agree that you will not, and will not permit anyone using the Service on your behalf to:
- Make or send any call, text message, fax, voicemail, or other communication that violates the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule, the federal or any applicable state Do-Not-Call (DNC) registries, calling-time restrictions, consent or identification requirements, or any other telemarketing, anti-spam, or consumer-protection law;
- Contact, or continue to contact, any person who has asked not to be contacted, is registered on a Do-Not-Call list, or is shown in the Service as “Do Not Call” or otherwise flagged dnc;
- Use the Service or any data from it for any purpose regulated by the Fair Credit Reporting Act (FCRA) — including evaluating a person’s eligibility for credit, employment, insurance, housing, or any other FCRA-permissible purpose. The Service is not a consumer reporting agency and the data is not a consumer report;
- Send unsolicited commercial email in violation of CAN-SPAM or any applicable anti-spam law;
- Harass, stalk, threaten, defraud, discriminate against, or otherwise harm any person, or use the data to do so;
- Sell, sublicense, redistribute, scrape, harvest, or build a competing data product from the Service or its data, except as expressly permitted in writing;
- Attempt to re-identify, cross-reference, or enrich the data in any way that violates an individual’s privacy rights or any applicable law;
- Share account credentials, circumvent scan metering or coverage checks, or access the Service by any automated means other than the interfaces we provide;
- Reverse engineer, interfere with, overload, or attempt to gain unauthorized access to the Service or any provider’s systems;
- Violate any third-party provider’s terms, any public-records license, or any applicable local, state, federal, or international law.
You are responsible for scrubbing your outreach against the applicable Do-Not-Call registries and for honoring every opt-out request before contacting anyone. Marking or honoring a “Do Not Call” flag in the Service does not, by itself, make your outreach lawful — that responsibility is yours.
Contact lookup & enrichment
The Service helps you record contact details for a lead in two ways:
- Manual lookup (free). A “Find contact” link opens a search in your own browser so you can look up a number yourself and save it to the lead, with an optional Do-Not-Call flag. The Service does not scrape people-search websites on your behalf.
- Licensed enrichment (optional, rolling out). Where available, enrichment queries a licensed skip-trace provider — under our agreement with that provider — for a phone number and a Do-Not-Call indicator, and only when you request it for a specific lead. Features marked “rolling out” are not yet available and are not a commitment to deliver by any particular date.
Contact data may be incomplete, out of date, or associated with the wrong person. You are responsible for verifying it and for ensuring that any outreach complies with Section 7 (Acceptable use), including TCPA and Do-Not-Call requirements. Where a lead is flagged “Do Not Call,” you must not call or text that number.
Public records, sources & accuracy
Data is aggregated from public county records and from licensed data providers we work with. Public records lag real-world events — often by 30–60 days — and may be delayed, incomplete, inaccurate, duplicated, or inconsistent from county to county. The Service is provided as a research and outreach tool, not as a verified or authoritative record. You are responsible for independently verifying any information before relying on it, and for confirming that your use of public-records data is permitted in your jurisdiction.
Third-party services
We rely on third parties to operate the Service: public county open-data portals and licensed property-data and skip-trace providers supply records, and Stripe processes subscription payments. Their availability affects the Service, and your payment details are handled under Stripe’s own terms and privacy policy. We do not control third-party services or their data, and their inclusion is not an endorsement.
Your data & privacy
Your account information and the leads in your workspace are stored on our servers, as described in our Privacy Policy. You can export your leads to CSV at any time, and you can ask us to close your account and delete your account data by emailing johnykidhole234@gmail.com. Data you export leaves the Service — keeping it secure, current, and lawfully used (including maintaining any internal Do-Not-Call list your business is required to keep) remains your responsibility.
Intellectual property
The Service — including its software, design, and branding (including the MoverScan name and camera mark) — is owned by MoverScan (Portland, Oregon) and protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes. Public-record facts themselves are not owned by us; the license above covers the Service and its software, not the underlying public facts.
Disclaimers
THE SERVICE AND ALL DATA ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data is accurate, complete, current, or fit for your intended use. To the maximum extent permitted by law, you use the Service and the data at your own risk.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MoverScan (Portland, Oregon) AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You will indemnify, defend, and hold harmless MoverScan (Portland, Oregon) and its officers, employees, and suppliers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the Service or data, your outreach to any individual, or your violation of these Terms or any law — including the TCPA, Do-Not-Call rules, FCRA, CAN-SPAM, and other privacy or consumer-protection laws.
Termination
You may cancel your subscription (Section 6) and stop using the Service at any time, and you may close your account by emailing johnykidhole234@gmail.com. We may suspend or terminate your access to the Service or any paid feature if you violate these Terms or use the Service unlawfully; if we terminate without cause during a period you have paid for, Section 6 (Refunds) applies. Provisions that by their nature should survive termination — including Acceptable use, Disclaimers, Limitation of liability, and Indemnification — will survive.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “last updated” date above, and material changes will take effect when posted or as otherwise required by law — and material changes to pricing or plan allowances follow the notice rules in Section 4. Your continued use of the Service after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the courts located in Multnomah County, Oregon, except where applicable law provides otherwise.
